Can I form an LLC without being a US resident?
Yes. No US citizenship, residency or visa is required to form and own an LLC. Everything is done remotely: we file your Articles of Organization, provide the mandatory registered agent and request your EIN from the IRS.
How long does it take to form my LLC?
Allow 10 minutes to complete the configurator. We file your Articles of Organization within 24 to 48 business hours, depending on your package; the state then approves them in one to several days, depending on the state (often 1–2 days in Wyoming). The EIN then takes a few weeks, because the IRS processes non-residents’ applications manually.
Which state should I choose for my LLC?
For most online businesses run from abroad, Wyoming offers the best balance of cost, privacy and simplicity. New Mexico is the cheapest to maintain. Delaware mostly makes sense for raising money, and Florida or Texas if you have real operations there. The configurator recommends a state based on your project.
What is an EIN, and how do I get one without an SSN?
The EIN (Employer Identification Number) is your LLC’s federal tax ID, essential for opening a bank account or using Stripe. Non-residents without an SSN or ITIN are eligible: we prepare and file Form SS-4 with the IRS for you.
Does an LLC give me a visa or the right to live in the United States?
No. Owning an LLC gives you no right to live, work or obtain a visa in the United States. It lets you do business through an American company, from your own country.
Will I pay taxes in the United States?
By default, a single-member LLC owned by a non-resident is “disregarded” — tax-transparent — for the IRS. If it has no office, no employees and no real business activity in the US, it generally pays no federal income tax. It must, however, file Form 5472 with a pro forma 1120 return every year. Every situation is different: we’ll refer you to a tax specialist if needed.
How am I taxed in my country of residence?
You remain taxable wherever you’re a tax resident. In your country of residence, your LLC’s income generally has to be reported, and how it’s treated (tax-transparent or not, the risk of a permanent establishment if the company is managed from there) depends on your situation. An LLC is not a tool for escaping taxes: have your project reviewed by an accountant or a tax lawyer in your country.
Can I open a US bank account remotely?
Yes. Several US neobanks and financial services accept LLCs owned by non-residents, provided you have your Articles of Organization, your EIN and a valid ID. Acceptance criteria change and remain at each bank’s discretion: we prepare your application and point you to the options that fit your profile.
Can I use Stripe, PayPal or Amazon with my LLC?
Yes — it’s one of the main reasons to have an LLC. With your Articles of Organization, your EIN, a US address and a US bank account, you can open a Stripe US, PayPal Business or Amazon Seller account in your company’s name, subject to their verification checks.
What are an LLC’s annual obligations?
Every year: the federal filing (Form 5472 + pro forma 1120 for a single-member LLC owned by a non-resident), the state annual report if your state requires one (Wyoming, Delaware, Florida…) and the registered agent renewal. We send you a clear calendar and can handle all of it for you.
Do I need to report beneficial owners (BOI)?
Since March 2025, a FinCEN rule has exempted companies formed in the United States from the beneficial ownership information (BOI) reporting required by the Corporate Transparency Act. These rules are evolving: we monitor them and will let you know if a filing becomes necessary again.
What is a registered agent?
Every LLC must appoint a registered agent: a physical address in the state of formation that receives official mail and legal documents. It’s included for 12 months in all our packages.
What happens after the first year?
Nothing renews without your consent. The only mandatory recurring costs are the registered agent, the state’s annual fees (depending on the state) and your federal filing. We show you these amounts from day one, so there are no surprises.
Can I get a refund?
Yes. As long as we haven’t filed your Articles of Organization with the state, you can cancel and get a full refund. Once they’ve been filed, the state fees can no longer be recovered.
